1. General information
This course contributes to the training of Army Officers, providing knowledge and developing skills necessary for them to perform their mission. The contents of the course will include:
- Fundamentals of Law.-Concept of Ethics, moral duty and law. Sources of Law. Concept of Legal Norm.
- Constitutional Law.-Territorial organization of the State. Powers of the State. Rights and Duties: special reference to the military. National Defense in the Constitution. Cyber defense.
- Law of Armed Conflicts.-Basic notions. Main Conventions and Protocols on the subject. Methods and means of combat. New weapons and threats. International criminal jurisdictions.
2. Learning results
In the Defense profile, passing the subject enables the student to have adequate knowledge of the legal framework of the military profession, from the Fundamentals of Law to the Law of Armed Conflicts. To achieve this, the student must:
- Understand the legal framework of the professional activity.
- Understand the Spanish legal system, its sources, and general principles.
- Know and assume ethical standards of conduct, legal values, and Human Rights.
- Understand the constitutional principles and organization of the Spanish State.
- Apply the International Law of Armed Conflicts (ILAC).
- Analyze the different Conventions and Treaties related to ILAC signed by Spain.
- Be aware of the need to always apply ILAC in their work as a military and the sanctions imposed for non-compliance.
- Have the ability to plan operations while keeping in mind ILAC.
Likewise, it will have the capacity to plan, budget, organize, direct and control tasks, people and resources. It will possess the ability to solve problems and make decisions with initiative, creativity and critical reasoning. It will also have the capacity to apply information and communication technologies in Engineering, as well as communicate and transmit knowledge, skills and abilities in Spanish.
The students will also have the ability to analyze and assess the social and environmental impact of technical solutions while acting with ethics, professional responsibility, and social commitment, always seeking quality and continuous improvement. They will also have the ability to work in a multidisciplinary group and in a multilingual environment. Additionally, they will have the ability to manage information, handle and apply the necessary technical specifications and legislation for the practice of engineering. Furthermore, they will have the ability to learn continuously and develop strategies for autonomous learning. Finally, they will have knowledge of the fundamentals of law, constitutional law, and law of armed conflicts, which will enable them to exercise the profession.
3. Syllabus
FIRST BLOCK - FUNDAMENTALS OF LAW
5 topics. Concept of law, Sources of law, Pluralistic Legal System, State of Autonomies, and, Legal Norm.
SECOND BLOCK - CONSTITUTIONAL LAW
6 topics. Constitutional History. Generalities of the Constitution. The Crown. Powers of the State. Armed Forces in Spain, and, constitutional rights and duties of its members.
THIRD BLOCK - INTERNATIONAL LAW OF ARMED CONFLICTS
11 topics. Generalities of the ILH, and, the use of force at the international level. Geneva Conventions and their Additional Protocols. Means of warfare. Methods of warfare. Protection of the environment, and, of cultural property. Ad-hoc tribunals and the ICC.
4. Academic activities
- Lectures: If face-to-face teaching cannot take place due to health reasons, lectures will be conducted online.
- Legal debates in the classroom.
- The professor will comment on news that will help students understand the subject matter. Students will also present relevant news related to the subject.
- At the beginning of each session, students may be asked to provide a brief summary of the previous session.
- Personal study of the subject matter by students.
- Personalized attention through tutoring sessions. Tutoring sessions will be held at least 48 hours in advance, and the location and schedule will be posted on the Virtual Classroom.
5. Assessment system
FIRST CALL
Continuous Assessment
- (A) Active participation during classes and in Virtual Classroom activities. (5% and 15%, respectively).
- (B) Oral and written presentation of an original paper on a topic related to the subject. (5% and 15%, respectively).
- (C) First exam corresponding to Domestic Law (Block I and II). (30%).
- (C) Second exam, which if the student had passed the Domestic Law exam, will only consist of the evaluation of the contents of the LOAC (Block III). (30%).

To pass the subject, the student must obtain a final grade greater than or equal to 5.
Global Exam
- Written exam: Three open-ended questions (one from each Block).
- Oral exam: Brief presentation on the most relevant legal news in the country or assigned area, including a small legal analysis related to the syllabus.
To pass the course, the student must obtain a final grade of 5 or higher.
SECOND CALL
Written exam covering the entire course syllabus, which will have a weight of 100%. To pass the course, the student must obtain a final grade of 5 or higher.
